TERMS & CONDITIONS
By booking a photography session, submitting a deposit, or making any payment toward a session, the client acknowledges that they have read, understood, and agreed to the following Terms & Conditions. These policies are intended to establish clear expectations between the photographer and the client and apply to all photography sessions unless otherwise agreed upon in writing.
BOOKING CONFIRMATION & DEPOSIT
A $50 non-refundable deposit is required to secure and confirm all photography session bookings. The deposit must be paid before a booking is considered official.
Submitting a booking inquiry, discussing a potential date, or receiving confirmation of availability does not guarantee that a session has been reserved. Your session is not officially booked until the required $50 deposit has been received.
All dates are reserved on a first-paid, first-confirmed basis. If a client delays payment of their deposit and another client books and pays for the same date, the photographer is not responsible for the original client's loss of that date. The photographer is under no obligation to hold a date without receiving the required deposit.
The deposit compensates the photographer for reserving the requested date and potentially declining other booking opportunities. Once paid, the deposit is non-refundable in the event of a client cancellation, subject to applicable law and the photographer cancellation policy outlined below.
REMAINING BALANCE & PAYMENT REQUIREMENTS
Unless otherwise agreed upon in writing, the remaining balance is due on the scheduled session date.
Clients are responsible for ensuring that all payments are completed in full and on time. Failure to pay the outstanding balance may result in the withholding of final edited images until the account has been paid in full.
Any alternative payment arrangements must be approved by the photographer in writing before the session.
CLIENT CANCELLATIONS & REFUND POLICY
If a client chooses to cancel their photography session for any reason, the $50 deposit will not be refunded, subject to applicable law.
If a client pays the full session balance in advance and subsequently decides to cancel, all payments made toward the session, including the deposit and remaining balance, are non-refundable to the extent permitted by applicable law.
Clients are encouraged to carefully review their schedules and confirm their availability before making a booking. By submitting payment, the client acknowledges and accepts the cancellation and refund policy.
PHOTOGRAPHER CANCELLATION
If the photographer must cancel the session and cannot provide the agreed-upon service, the client will receive a refund of the $50 deposit and any additional payments made for services that will not be provided, subject to applicable law.
The photographer will communicate with the client regarding the cancellation and, where appropriate, may offer an alternative date if both parties agree.
WEATHER CONDITIONS & RESCHEDULING
Photography sessions, particularly outdoor sessions, may be affected by rain, thunderstorms, high winds, extreme temperatures, or other weather conditions that make a session impractical or unsafe.
If weather conditions prevent the session from safely proceeding, the photographer and client may discuss rescheduling for a mutually agreeable date, subject to the photographer's availability.
Weather-related cancellations do not automatically qualify for a refund. The $50 deposit remains non-refundable, and payments made toward the session will be applied toward a rescheduled session rather than refunded, subject to applicable law.
By booking an outdoor photography session, the client acknowledges that weather is unpredictable and accepts the risk of weather-related changes. The client understands that rescheduling, rather than a refund, is the preferred resolution when weather prevents the session from proceeding.
The photographer will make the final determination regarding whether weather conditions are safe and suitable for the session.
If the client declines a reasonable rescheduling option following a weather-related cancellation, the standard client cancellation policy will apply, subject to applicable law.
If the photographer is unable to offer a reasonable rescheduling option, the parties will communicate to determine an appropriate resolution consistent with applicable law.
RESCHEDULING & LATE ARRIVALS
All rescheduling requests must be communicated to the photographer as early as possible. Rescheduling is subject to availability and is not guaranteed.
A client-requested change of date does not automatically entitle the client to a refund. Any transfer of a deposit or payment to a new date must be approved by the photographer.
Clients are expected to arrive at the agreed-upon time and location. Late arrivals may reduce the amount of time available for the session. The photographer is not obligated to extend a session or provide additional images because of a client's late arrival.
If a client arrives late, the session may still need to end at the originally scheduled time to accommodate other commitments.
IMAGE SELECTION & DELIVERY
Clients will receive only the number of final edited photographs specifically agreed upon at the time of booking.
The number of images included in the client's package will be communicated before or during the booking process. The client acknowledges that the agreed-upon quantity is the maximum number of images included in the package unless additional images are purchased.
The photographer retains the right to select, edit, and deliver the final photographs based on professional judgment and artistic style, unless a different selection process has been agreed upon in writing.
The photographer does not provide RAW, unedited, original, or unprocessed image files. This includes RAW camera files, unedited photographs, rejected images, test shots, duplicates, and any other images not selected for final delivery.
The client understands that not every photograph taken during a session will be delivered. Only the agreed-upon number of final edited images will be provided unless additional images are purchased.
ADDITIONAL IMAGE PURCHASES
Clients may purchase additional edited photographs beyond the number included in their original package for $5 per additional image
Additional images must be requested and paid for according to the photographer's instructions before delivery. The photographer is not obligated to provide additional photographs free of charge or to deliver more images than originally agreed upon.
Additional image purchases are subject to image availability and the photographer's selection and editing process. The $5 fee applies to each additional final edited image and does not entitle the client to RAW or unedited files.
EDITING STYLE & ARTISTIC DISCRETION
The client acknowledges that the photographer has an individual artistic style, editing process, and creative approach.
By booking a session, the client confirms that they have reviewed the photographer's portfolio, examples of previous work, or other available samples and understand the general style of the final photographs.
Editing decisions, including color grading, lighting adjustments, cropping, retouching, and other artistic choices, are made at the photographer's discretion unless specific editing requests have been agreed upon in writing.
Extensive retouching, major alterations, or editing outside the photographer's standard style may require an additional fee or may not be available.
CLIENT RESPONSIBILITIES
The client is responsible for providing accurate booking information, arriving prepared for the session, and communicating relevant preferences or requests in advance.
The client is responsible for obtaining any necessary permissions for the session location and ensuring that all participants are aware of and agree to participate in the photography session.
The photographer is not responsible for limitations caused by venue restrictions, location conditions, uncooperative participants, or other circumstances outside the photographer's reasonable control.
Clients are encouraged to communicate special requests before the session. Requests made during or after the session may not be accommodated if they fall outside the agreed-upon package or the photographer's available services.
IMAGE DELIVERY & FILE STORAGE
Final edited images will be delivered through the photographer's designated delivery method once the editing process is complete and all required payments have been received.
Delivery timelines may vary depending on workload, session type, and other circumstances. Any specific delivery timeframe communicated to the client will serve as the expected timeframe, subject to reasonable delays.
Clients are responsible for downloading and securely saving their delivered photographs. The photographer is not obligated to maintain permanent storage of delivered galleries or files unless otherwise agreed upon in writing.
COPYRIGHT & IMAGE USAGE
Unless otherwise agreed upon in writing, the photographer retains the copyright to all photographs created during the session.
The client receives permission to use the delivered photographs for personal purposes, subject to any usage terms communicated by the photographer. The client may not claim authorship of the photographs, commercially sell or license them, or otherwise use them beyond the granted permissions without the photographer's written consent.
Any commercial usage rights or additional licensing terms will be communicated separately when applicable.
AGREEMENT & ACCEPTANCE
By submitting the required deposit, making any payment toward a session, or proceeding with a booked photography session, the client acknowledges that they have reviewed and agreed to these Terms & Conditions.
The client specifically acknowledges and understands that:
- A $50 deposit is required before a booking is officially confirmed.
- The deposit is non-refundable for client cancellations, subject to applicable law.
- If the photographer cancels and cannot provide the agreed-upon service, the deposit and payments for services not provided will be refunded.
- Weather-related cancellations generally result in a discussion about rescheduling rather than a refund, subject to applicable law.
- Full payment does not entitle a client to a refund if they subsequently cancel before the session takes place
- RAW and unedited images are not provided.
- Only the number of edited images agreed upon at booking is included.
- Additional edited images are available for $5 each.
Any exceptions or modifications to these Terms & Conditions must be agreed upon in writing by both parties.
The photographer reserves the right to update these Terms & Conditions for future bookings. Changes will not improperly alter existing agreements.
